These terms establish the legal rights and obligations between you and Loan Gospel. ("LG," "we," "our," or "us"), the operator of the Site. By accessing or using the Site, you explicitly acknowledge and agree that you are entering into a binding legal agreement with us. You further confirm that you have understood and accepted these Terms of Use, including the Privacy Policy and the Consent for Electronic Signatures. If you do not agree to these Terms, please refrain from accessing or using the Site.

  1. Modification: We reserve the right to modify these Terms at our discretion. Any changes will become effective ten (10) days after we post the revised Terms on the Site. By continuing to use the Site after such changes, you indicate your acceptance of the modified Terms.

LG does not guarantee that the offers provided by partners will have the best rates or terms available in the market. By submitting a Match Request, you consent to partners contacting you via various means of communication, even if your telephone number is on a Do Not Call Registry. You agree to contact specific partners directly if you no longer wish to receive communications from them. LG is not responsible for a partner's failure to comply with your request to stop contacting you.

  6. Third-Party Sources and Content: The Site enables you to access and interact with third-party websites, services, and content ("Third Party Sources"). We do not control these Third Party Sources and disclaim responsibility for their content, terms of use, privacy policies, or actions. Your interaction with Third Party Sources is at your own risk, and you agree to waive any legal rights or remedies you may have against LG regarding Third Party Content.

Intellectual Property Rights: The Content on the Site, including text, graphics, trademarks, and other materials ("Materials"), is owned or licensed by LG and protected by applicable copyright and intellectual property laws. You may only use the Content for personal, non-commercial purposes with our prior written consent. You must retain all copyright and proprietary notices if you download or print any Content.

  8. User Submissions: The Site may allow you to submit, host, and share content ("User Submissions"). You are solely responsible.

8.1. Responsibility.

The Site may permit the submission, hosting, sharing and publishing of Content by you and other users ('User Submissions'). You understand that whether or not such User Submissions are published, we do not guarantee any confidentiality with respect to any User Submissions. You shall be solely responsible for your User Submissions and the consequences of posting, publishing or uploading them. We have complete discretion whether to publish your User Submissions and we reserve the right in our sole discretion and without further notice to you, to monitor, censor, edit, remove, delete, and/or remove any and all Content posted on the Site (including User Submissions) at any time and for any reason.

8.2. Ownership.

You represent and warrant that you own or have the necessary rights and permissions to use and authorize the Site to use all Intellectual Property Rights (defined below) in and to your User Submissions and to enable inclusion and use thereof as contemplated by the Site and these Terms. Unless the User Submissions are separately referred to, all references herein to Content shall include references to User Submissions. "Intellectual Property Rights" means any and all rights, titles, and interests, whether foreign or domestic, in and to any and all trade secrets, patents, copyrights, service marks, trademarks, know-how, or similar intellectual property rights, as well as any and all moral rights, rights of privacy, publicity and similar rights of any type under the laws or regulations of any governmental, regulatory, or judicial authority, foreign or domestic. You retain all of your ownership rights in and to your User Submissions.

8.3. License to User Submissions.

By submitting the User Submissions to LG, you hereby grant LG a worldwide, irrevocable, non-exclusive, royalty-free, perpetual, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of display, and perform the User Submissions in connection with the Site and LG business, including without limitation for redistributing part or all of your User Submissions (and derivative works thereof) in any media formats and through any media channels and, and you hereby waive any moral rights in your User Submissions, to the extent permitted by law. You also hereby grant each user of the Site or other viewer or user of the User Submission a non-exclusive right to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions, all in accordance with these Terms.

8.4. Prohibited Content.

You agree that you will not display, post, submit, publish, upload or transmit a User Submission that: (i) is unfair or deceptive under the consumer protection laws of any jurisdiction; (ii) is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights; (iii) creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or interferes with an investigation by law enforcement; (iv) impersonates another person; (v) promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking; (vi) is unlawful, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, gives rise to civil liability, violates any law, or is inappropriate; (vii) involves theft or terrorism, or (viii) is otherwise malicious or fraudulent.

8.5. Exposure.

You understand and acknowledge that when accessing and using the Site: (i) you will be exposed to User Submissions from a variety of sources and that LG is not responsible for the accuracy, usefulness, safety, or Intellectual Property Rights of, or relating to, such User Submissions; and (ii) you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable. You hereby agree to waive and hereby do waive, any legal or equitable rights or remedies you may have against LG with respect to (i) and (ii) herein.

 

8.6 Complaints about Content.

LG respects the Intellectual Property Rights of others. Therefore, we encourage you to report any Content you believe violates your Intellectual Property Rights.

 

9. User Profile:Our services are available to both registered users and guests. This section of the Terms applies specifically to registered users. During the registration process, we may request certain contact and personal information, such as your name, email address, profile picture, address, and phone number. Mandatory fields will be clearly indicated. 

Please note that providing false, incorrect, or outdated information may hinder your registration and affect our ability to deliver services to you. To log in, you will need to provide your email and password. We may also introduce additional or alternative means of identification and authentication periodically for logging in and accessing the service. 

You agree to maintain strict confidentiality of your login details and refrain from disclosing them to others. It is recommended to change your password regularly, at least once every six months. You are responsible for any content you upload or provide, including any links to external websites, as part of a User Submission. 

We shall not be held responsible for any consequences arising from your failure to provide accurate and complete information during the registration process or for any misuse of your profile resulting from compromised or shared login details. 

If you wish to have your user profile removed, you can request its deletion. We may require additional information to verify your identity through email or alternative means before processing your request. Once your request is processed, your account will be terminated, and you will no longer have access to the service as a registered user. 

Subject to these Terms, you may re-register at any time following the termination of your account by completing the registration process again. 

Regardless of any available legal remedies, we reserve the right, at our sole discretion, to temporarily or permanently deny, limit, suspend, or terminate your user profile, restrict your access to the service, remove your uploaded content, and employ technical and legal measures to prevent your use of the service if we determine that: 

  • You have misused your rights to use the service. 

  • You have violated the Terms. 

  • You have breached any applicable laws, rules, or regulations. Your actions or omissions are harmful or likely to be harmful to us, other users, or service providers. 

 

 

10. Information Accuracy: While we strive for accuracy, we cannot guarantee that the Content available on the Site is completely accurate, reliable, current, or free of errors. We reserve the right to make changes to the Content or any part of it at our sole discretion, without prior or subsequent notice.   3. You do not misrepresent your relationship with LG or provide false information.

13. Privacy. We handle personal information collected through the Site in accordance with our privacy policy, available at Privacy Policy. By providing or making personal information available to us, you agree to its use as outlined in the Privacy Policy. 

 

14. We are not a Partner. The Site assists you in connecting with Partners based on your provided information but is not a lending institution, insurance provider, or other Partner. We do not participate in coverage or credit decisions made by referred Partners. We do not issue mortgages, credit cards, insurance coverage, or other financial products. 

 

15. Your Financial Decisions and Responsibilities. The Site helps you find Partners based on your needs and information, but we do not endorse or control Partner products or services. We are not your agent or advisor, and we do not validate or investigate Partner qualifications. You are solely responsible for evaluating and vetting each Partner before engaging with them. Your financial decisions are your own, and you rely on your own judgment when selecting Partner products or services. 

 

16. Warranty Disclaimers.

16.1. These disclaimers apply regardless of whether services are paid for. Certain exclusions may not apply according to applicable law. 

16.2. We do not warrant or represent the terms, rates, fees, quotes, or services offered by Partners or third-party sources. We do not guarantee that their offerings are the best available. The Site is provided "as is" and "as available," without warranties of any kind. LG disclaims all warranties, express or implied, including but not limited to merchantability, title, fitness for a particular purpose, non-infringement, and those arising by statute or from a course of dealing or usage of trade.

16.3. Our content and services aim to assist you with financial decisions but may not consider your specific financial situation. It is your responsibility to seek additional information and advice from qualified professionals aware of your circumstances. LG does not endorse or guarantee user-submitted content and disclaims liability for such content.16.4. Your use of the Site content or interaction with third-party features is at your own risk. You are responsible for reading and complying with the terms and conditions of third-party sources. LG is not liable for any claims or damages arising from disputes with third parties resulting from your use of the Site. 

 

17. Limitation of Liability: 

17.1. To the maximum extent permitted by applicable law, LG shall not be held liable for any indirect, exemplary, special, consequential, or incidental damages of any kind, or for any loss of data, revenue, profits, or reputation arising under these terms or as a result of your use of, or inability to use, the site, even if LG has been advised of the possibility of such damages or losses. Please note that in certain jurisdictions, the limitation or exclusion of liability for incidental or consequential damages may not be enforceable, and therefore, the above limitations may not apply to you. 

17.2. Under no circumstances shall LG’s total liability for any and all damages arising under these terms or as a result of your use of, or inability to use, the site exceed the total amount of US$100.

 

18. Indemnity: You agree to indemnify, defend, and hold LG, our affiliates, and our respective officers, directors, employees, and agents harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: 

  1. your use of, or inability to use, the site; 

  2. your user submissions; 

  3. your interaction with any site user; or 

  4. (IV)your violation of these terms. 

 

19. Term and Termination: These terms remain in effect until terminated by LG or you. LG reserves the right, in its sole discretion, to terminate these terms and/or your access to the site, or any part thereof, at any time and with or without cause (including, but not limited to, for a breach of these terms). LG shall not be liable to you or any third party for the termination of the site or any part thereof. If you object to any term or condition of these terms, or any subsequent modifications, or if you become dissatisfied with the site in any way, your only recourse is to immediately discontinue the use of the site. Upon termination of these terms, you must cease all use of the site. This section 17 and sections 5 (Sharing Your Information), 7 (Intellectual Property Rights), 11 (Privacy), 14 (Warranty Disclaimers), 15 (Limitation of Liability), 16 (Indemnity), and 19 (General) will survive the termination of these terms. 

 

20. Assignment: You may not transfer or assign these terms or any rights and licenses granted hereunder. However, LG may assign these terms without any restriction or notification to you. 

21. General: LG reserves the right to discontinue or modify any aspect of the site at any time. These terms and the relationship between you and LG shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. You agree to submit to the personal and exclusive jurisdiction of the courts located in California and waive any jurisdictional, venue, or inconvenient forum objections to such courts. These terms constitute the entire agreement between you and LG regarding the site. If any provision of these terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. No waiver of any term of these terms shall be deemed a further or continuing waiver of such term or any other term, and a party's failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision. YOU AGREE THAT ANY CAUSE OF ACTION THAT YOU MAY HAVE ARISING OUT OF OR RELATED TO THE SITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION OCCURS OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

PRIVACY POLICY

This privacy policy ("Privacy Policy") is designed to describe Loan Gospel (“LG”, "we", "our" or "us") data collection practices in connection with this site (together with its subdomains, features, and services available thereon, the "Site"), and in connection with your use or engagement with any feature, content, offer, element or service we make available to you via the Site (the “Services”). 

We reserve the right, in our sole and absolute discretion, to change this Privacy Policy at any time. In which case, we will post the modified Privacy Policy on the Site, and the “Last Updated” statement at the bottom shall reflect the effective date of the modified version. Any access or use you make of the Site following such date, constitutes your consent and acceptance of the modified Privacy Policy. If we make significant changes, we will make sure to provide more prominent notice to you, such as posting a notification on the Site, seven (7) days before the changes become effective. In which case, the changes will be effective seven (7) days after such notification was published.

3.1. Information You Provide to Us. Some of the Services will require you to provide or submit certain Personal Information in order to be able to use them. Such Services and features are subject to your specific and active consent and choice (e.g. providing your financial information to be contacted with potential loan offers from Partners, subscribing to newsletters which may become available in certain Sites from time to time, and more) , and some will be collected upon your consent to this Privacy Policy, as described below.

For the purposes of this Privacy Policy, "Personal Information" means information that may be used, either alone or in combination with other information, to personally identify an individual, such as a first and last name, an email address, phone number, a home or other physical address, and other contact information. In some jurisdictions and given the specific use we make with the information, an IP address that your Internet service provider allocates for your device, may also be considered as Personal Information. In which case, we will be treating the IP address as personal in all handling and safeguarding aspects. 

3.1.1. Third Party Forms and Services: The Site lists, rates and compares various 3rd party businesses, lending partners, platforms, brands and commercial entities in the financial services market (collectively, "Partners") and their respective products and/or services (collectively, "Products"). We may, from time to time, provide you with offers, services and Products of Partners via an online request to be filled by you, upon your intent choice and consent, and such information will be used to facilitate your connection and/or engagement with the relevant Partners (“Lead”). Your submission of information will also be provided directly to our Partners and will be used according to this privacy policy as well as such Partners’ own privacy policy. Additionally, if you want to receive more information about a Partner or a Product, or if you otherwise want to pursue a transaction with a Partner, and you click the relevant Partner icon or tab, you may be directed to a landing page or an online form that is owned and operated by the Partner (the "Landing Page"); similarly, you may also be directed to the Landing Page through other websites and online searches. In either case, however, you may be prompted to submit certain information on the Landing Page, including Personal Information such as your name, email address, and phone number (such information collectively, "Landing Page Info"). The Landing Page Info that you submit is collected directly by the Partner who provided it and will include its own privacy policy and data collection practices information. We advise you to refer to such a privacy policy to better understand the purpose of collection and use of the Personal Information you submit. 

3.1.2. Contact Us. If you send us a ‘Contact Us’ (or similar) request, whether by submitting an online form that we make available, by sending an email to an email address that we display, by using a feedback or reporting feature that is available on the Site, or by other means, you may be required to provide us with certain Personal Information, such as your name and email address. Such information, including the content of your approach, will be used for the purposes of processing and addressing your request and for our legitimate business purposes, as further described in section 4 and 5 of this Privacy Policy.

3.1.3. Blogs, Newsletters, Surveys and Promotions. The Site may contain a blog forum, reviews, and articles displaying information about our services, Partners, Products, and the relevant market vertical. The Site may also offer you the opportunity to subscribe to newsletters and participate in surveys and other promotional activities (some of which may be administered by us, and some of which may be administered by third party services with which we engage). In each of the foregoing cases, your interaction (such as responding on the blog forum, subscribing to a newsletter, or participating in a survey) may require you to provide certain Personal Information such as your name and email address. 

3.2. Information We Collect from You. We collect information about your use of the Services and your interaction with the Site or the Services, as follows, and in the following ways:

3.2.1. Device Information: For delivering and compatibility purposes, so as for language, geographic location and time zone, we collect device information such as: device type and version, operating system type, language and version, and information that can be extracted out of a user agent, such as browser type and version, screen resolution. 

3.2.2. Interactions and Usage: In order to provide the Services, operate the Site, and keep improving it, so as to be able to sync with our Partners and affiliates, we collect information about your interaction and use of the Services, such as: URLs from which you were directed to the Site and to which you are referred from the Site, internal URL’s of the Site in which you visited and your actions with respect to the Services (such as view or click), date/time stamp of Site use, timing for clicks and page-views.

3.2.3. Log Files: We collect information through server log files, but also by deploying tracking technologies within the Site, such as pixel tags. We do this to analyze trends, track user’s engagement and interaction with the Site and respective Services. The type of information collected may include internet protocol (IP) addresses that your Internet Service Provider allocated to your device. We collect IP for limited time and for specific purposes. One, is to better understand your geographic location (country, region, and language) and therefore be able to provide the Services in your own language and relevant to your place of origin. Second, we use automated tools to analyze IP addresses and flag those that are fraudulent. Third, we may retain your IP address to evidence any consents you have given us or the Partners. 

3.2.4. Cookies and Similar Technologies. The Site may use "cookies" and other anonymous web tracking technologies (such as "web beacons" and "pixel tags") implemented by us or by third party service providers. 3.3. Information we receive from Third Parties. Like many Internet based services, the Site and the Services are operated and provided in collaboration, sync and interaction with third parties, including Partners, affiliates and other third parties. In order to enable and facilitate such sync, as well as to provide you with tailored offers and services from Partners,  we may receive information from third parties, such as: an internal user identifier that out system generates to each user, details of Products you purchased, or applied for, from the Partners,  and a summary of action taken by you (e.g. click, purchase, view, form submission or a phone call). In some Sites, you will be able – upon your choice – to consume the Service on a click-by-call basis. In which case, a third-party vendor/s facilitates the call transmission, tracking and feedback for success. In such cases, the phone number from which you called may be provided to us (with no other information about you attached), for limited time and for purposes of resolving referrals and successful calls with our Partners. Except for this purpose, we do not make any other use of such information, unless you will give us your explicit consent.

4. Consent, Choice and Modifications. You are not legally obligated to provide us with Personal Information (and you acknowledge that providing us with Personal Information is done freely). 6.1. Data Storage and Security Platforms (“Data Platforms“); We use third party cloud and storage services to store and retain all Information that we collect about you. These Data Platforms may be located anywhere in the world. However, their practices and activities are fully governed by their own privacy policies. 

6.2. Social Media Platforms. We may share information with social media platforms (such as YouTube, Meta, LinkedIn etc.) for marketing and operation purposes. Such social media platforms may collect your Personal Information independently and may combine the not identified information provided by us, with your Personal Information which they collect to which you gave your separate and independent consent. Any such action and any Personal Information that may derive from it is subject to the social media's own privacy policy and is not, governed, controlled, or known by us. To the extent provided by law, you may opt-out from this data sharing according to section 9 below (Privacy Notice for California Residents).

6.3. Third Party Service Providers. We may send or otherwise share your Information to/with various third party service providers that help us with our business operations (for example, customer service operators and email or phone administration providers), that help us understand how our users use the Site and Services, operate them and to improve them.

6.4. Enforcement. We may share your Personal Information with any third party if we believe that disclosure of such information is helpful or reasonably necessary to: (a) comply with any applicable law, regulation, legal process, or governmental request; (b) enforce our Terms of Use, including investigations of potential violations thereof; (c) detect, prevent, or otherwise address fraud or security issues; and/or (d) protect against harm to the rights, property or safety of LG, our affiliated entities, our users, yourself, and/or the public.

6.5. Offerors. The Services may include submission of an online request, in case you will choose and be interested to receive offers from our Partners based on your Personal Information  (”Request”). In which case, we will send your Request information or otherwise share it to/with our Partners and service providers in order for such Partners to provide you with personalized offers and to contact you with the information you have requested. When you submit a Request, both LG and offerors may contact you directly with quotes or offers via all means of communication provided by you: mail, email, telephone, text message, fax, and others. you may receive telemarketing calls from offerors or third parties on their behalf (including using an automatic telephone dialing system or an artificial or prerecorded voice) as a consequence of submitting a request through our services, even if your telephone number is registered on a state, corporate or federal do not call registry. You will be able to find the identity of the Partner with whom information is shared, or a list of such Partners and service providers with whom such Request information is shared, before you give us your consent for such sharing. In either case, you acknowledge that: (a) the Partners may contact you using the Request information which you submitted; (b) we do not control the way in which Partners may contact you, or the subject matter of such contact; and (c) each Partner is required to provide its own privacy policy, and so it would not necessarily adhere to this Privacy Policy. 

6.6. Affiliates, Merger, Sale or Bankruptcy. We may share your information with our group companies (e.g. parent company, subsidiary, sister company or other affiliated entities). In the event that LG or one of our affiliated entities is acquired by, or merged with, a third party entity, or otherwise sells all or part of our/its assets, we may (and hereby reserve the right to) transfer or assign the Personal Information and other information we have collected or received. In such a case, we will require the acquiring entity to post its data practices and provide you with any of your rights as per the jurisdiction of your residency.

Third parties we engage or host or provide us with services and features we can offer to you, collect data from the Site and visitors’ engagement with the content and features on our behalf, or for the provisioning of their services.
